In New York, State laws that apply to marijuana focus on possession and sale. Unlawful possession of marijuana is the lightest law, and occurs simply when an individual is found to be in possession of the drug. This violation is punishable by a maximum $100 ticket on a first offense, a $200 maximum ticket on a second offense, and a $250 ticket on a third offense with up to 15 years in jail. Other crimes such as criminal possession of marijuana and criminal sale of marijuana offer varying degrees of charges based on the quantity found, at a minimum of 2 ounces to be in possession or intended for sale, with the penalties for conviction allowing extensive prison terms as the quantities increase.
