New York City Burglary Attorney

Burglary Defined

Whereas burglary once meant breaking into a home at night with the intent to commit theft, it has evolved to cover much more. Today it can include unlawful entry into almost any type of structure (not just a home or building) with the intent to commit any type of crime. No actual physical breaking of a lock or door need occur. You could literally trespass through an open door and be charged with burglary. New York classifies three degrees of burglary:

  • 3rd Degree Burglary: a Class D felony, the judge is allowed to sentence up to 7 years in prison for a conviction.
  • 2nd Degree Burglary: In addition to entering the premises illegally, this crime involves injuring others and using or displaying weapons. It is a Class C felony and punishable by one to 15 years in prison.
  • 1st Degree Burglary: The most serious charge of the three, it is a Class B felony and punishable by one to 25 years.
